      Proceedings of the Mayor & Council of the City of Brunswick 
      City of Brunswick 
      Wednesday, February 7th, 1838 
                  At a meeting of the members elect of the 
      City Council for the City of Brunswick, held this day at 3 o’clock, P.M., 
      for the purpose of organizing & electing a Mayor, the following gentlemen 
      appeared to wit:  Urbanus Dart, Chas. Davis, James Moore, John 
      Franklin, Jr. Henry A. Breed, A.L. King& George Harrington, who 
      severally took & subscribed the following oath to wit: 
                  “I U. Dart, I, Chas. Davis, I, James Moore, 
      I, John Franklin, Jr., I, H.A. Breed, I, A.L. King, 
      I, George Harrington, do solemnly swear that I will well & truly 
      perform the duties of a member of the Council for the City of Brunswick, 
      by the adoption and enforcement of such measures as to me appear conducive 
      to the general welfare and permanent good of the City of Brunswick.”

                  Sworn & subscribed before me, this

                  After taking & subscribing the foregoing 
      oath the Council proceeded to the election of a Mayor, and on counting the 
      votes it was found that

      A.L. King was unanimously elected Mayor for 
      the ensuing year. 
                  The Council then proceeded to the 
      election of a City Clerk, and unanimously elected Chas. Davis to 
      that office. 
                  On motion, Doctor Frank Gage was appointed health 
      officer for the city. 
                  The Council then proceeded to the election of officers: 
                  John Franklin, Jr. was elected Sheriff 
                  James Moore was elected City Surveyor 
                  Moses W. Wilson was elected Measurer of Lumber 
                  Doctor Gee Dupree was elected City Treasurer 
                  John Anderson was elected Pilot for the Bar & Harbor of 
      Brunswick 
                  Peter H. Rowe was elected Pilot for the Bar & Harbor of 
      Brunswick 
                  J.A.D. Lawrence was elected Pilot for the Bar & Harbor 
      of Brunswick 
                  An order was passed requesting the City Clerk to notify the 
      above named persons of their election. 
                  The Council then adjourned to meet in Friday evening next, at 
      7 o’clock.

      City Council 
      Friday, February 9, 1838 
                  Met according to adjournment.  Present 
      the whole Board. 
                  The Clerk read a communication from Doctor Gee Dupree 
      accepting this office of City Treasurer. 
                  Doctor G. Dupree was also elected Collector for the 
      City. 
                  On motion it was ordered, that Dr. G. Dupree as 
      Collector & Treasurer, shall give Bond with good security to the Mayor & 
      Council of the City of Brunswick, in the sum of $7608.38, for the true & 
      faithful performance of the duties of his said appointments, &c. 
                  And that the said G. Dupree as Collector shall retain 
      two and a half per cent on all monies by him collected, & that as 
      Treasurer he shall receive two and a half per cent on all monies by him 
      paid out, as compensation for his services. 
                  The following ordinance was then passed: 
                  “Be it ordained by the Mayor & Council of the City of 
      Brunswick, & it is hereby ordained by the authority of the same.  That the 
      foregoing shall be the form by which all ordinances hereafter passed and 
      adopted by the Mayor & Council of the City of Brunswick, shall be 
      commenced, and that every section after the first of said ordinances, 
      shall have the following commencement to wit:  “And be it further ordained 
      by the authority aforesaid.”  And all ordinances & proceedings of the said 
      Mayor & Council shall be signed by the Mayor and attested by the City 
      Clerk.

                  At the same meeting the following 
      ordinance in relation to pilots, was passed: 
                  Be it ordained by the Mayor & Council of the City of 
      Brunswick, & it is hereby ordained by the authority of the same, That each 
      pilot heretofore & that may hereafter be elected for the Bar & Harbor of 
      Brunswick, shall before he receives his License enter into Bond to the 
      Mayor & Council in the sum of $1000 with good security for the faithful 
      performance of his duties according to law, & the ordinances of the said 
      Mayor & Council; and also take & subscribe the oath prescribed in the 4th 
      Section of the act of 1799.  The security on each Bond to be approved by 
      the Council after which the Mayor shall issue Licenses to said pilots, to 
      which he shall sign his name.  The License shall also be countersigned by 
      the City Clerk, who shall affix the City Seal thereto.

                  At the same meeting it was Resolved, by 
      the Mayor & Council of the City of Brunswick, That James Moore, 
      Esq. the City Surveyor, be, & he is hereby authorized & requested, to run 
      and mark distinctly the Northern line of the City to make a plat thereof & 
      return the same to the City Council. 
                  A.H. Merrian was elected Vendue[?] Master. 
                  An Ordinance respecting Vendue Masters & Licenses. 
                  Be it ordained by the Mayor & Council of the City of 
      Brunswick, & it is hereby ordained by the authority of the same, That each 
      Vendue Master before entering upon the duties of his office shall give a 
      Bond in the sum of $5000 to the Governor agreeably to the laws of this 
      State, & shall make quarterly

      returns of his sales to the Mayor & Council, & pay to 
      the City Treasurer the tax of one per cent required by law. 
                  Sec. 2d.  And be it further ordained by the authority 
      aforesaid, That all License hereafter granted by the Mayor & Council to 
      tavern keepers, shall be in & have the following form to wit; 
                  “License” 
                  By authority of the Mayor & Council of the City of Brunswick 
      ___________ is hereby authorized to keep a tavern or public house of 
      entertainment in said city for the space of one year, to wit from the 
      ______ day of ______________ eighteen hundred and _________ until the 
      ___________ day of _____________ eighteen hundred and _______.  And to 
      sell all kinds of liquor by less measure than one quart, during said 
      year.  This License being subject to be revoked and annulled by the said 
      Mayor & Council at any time when in their opinion such a measure shall be 
      necessary.

                  And that all Licenses hereafter granted 
      to persons to sell spirituous liquors by less measure than one quart, 
      shall be in and have the following form to wit:

      ____________ is hereby authorized to sell and retail spirituous liquors by 
      Case[?] or small measure in said city for the space of one year, to wit:  
      from the ____ day of  ____________ eighteen hundred and ___________ until

      the said Mayor & Council at any time when in their opinion such a measure

                  And that all Licenses to persons who sell 
      spirituous Liquors by the measure of one quart and more in said city shall 
      be and have the following form to wit: 
                  License 
                  By authority of the Mayor & Council of the City of Brunswick 
      ___________ is hereby authorized to sell spirituous liquors by the measure 
      of one quart or my larger measure in said city for the space of one year, 
      to wit:  from the ______ day of _________ eighteen hundred and ______ 
      until the ______ day of ____________ eighteen hundred and _______.  This 
      License being subject to be revoked and annulled by the said Mayor & 
      Council at any time when in their opinion such a measure shall be 
      necessary.

                  Sec. 3d.  And be it further ordained by 
      the authority aforesaid, That all Licenses shall be signed by the Mayor 
      and attested by the City Clerk.  Whit the blanks in the foregoing forms 
      shall be filled except signing the name of the Mayor by the City Clerk, 
      and shall by him be delivered to the persons authorized to receive the 
      same, for which service he shall demand and receive one dollar and twenty 
      five cents of each person taking a License.  And any License delivered 
      without the

      consent of the Council first obtained shall be null 
      and void. 
                  Sec. 4th And be it further ordained by 
      the authority aforesaid, That all Tavern keepers and all persons who sell 
      or retail spirituous liquors by less measure than one quart, shall pay for 
      their License fifteen—dollars a year; and person who sell liquors by the 
      measure of one quart or by larger measure shall pay ten dollars per year 
      for their Licenses within the City of Brunswick.  And the City Clerk 
      before delivering any License shall demand and receive the tax and fee 
      above specified, which said tax the said Clerk shall pay to the City 
      Treasurer & take his receipt for the same; and the said Clerk shall keep a 
      record of all the Licenses issued by him, and the amount paid for the same 
      which he shall submit to the inspection of the Mayor and Council whenever 
      requested to do so.

                  On motion:  John H. Short was 
      appointed Harbour Master—Also, on Motion, Lieut. J.L. Lock—was 
      appointed Street Commissioner, and his salary was fixed at four dollars 
      per day while employed upon the City works. 
                  On Motion:  the Council commented that John Franklin, Jr. 
      should receive a License to keep a Tavern for the present Year. 
                  On Motion:  the Clerk was requested by the Council, to procure 
      at the expense of the City suitable Books for the purpose of Keeping the 
      record &c.

      and Stationary for the use of the Council. 
                  The following ordinance in relation to hogs and pits was 
      passed: 
                  Be it ordained by the Mayor & Council of the City of Brunswick 
      and it is hereby ordained by the authority of the same.  That no hog or 
      hogs, pig or pigs, shall be permitted to run or go at large, in the 
      Streets or public Squares, of the City of Brunswick, and that such and 
      every time, any hog or pig shall be found running at large in said Streets 
      or public Squares, the owner thereof shall pay a fine of one dollar, to 
      the Sheriff of said City, whose duty it shall be to confine such hog or 
      pig, and give information to the owner of such confinement.  And in case 
      the Sheriff shall not know the Owner, he shall put up a notice of such 
      confinement in tow of the most public places in said City.  And if the 
      owner does not pay the said fine of one dollar and take away his said hog 
      or pig within forty-eight-hours after he receives notice or after 
      publications of notice of its confinement, the Sheriff shall expose said 
      hog or pig at public sale and sell it to the highest bidder, and pay the 
      money after deducting the fine and ten per cent on the amount of sale into 
      the City Treasury for the use of the City. 
                  This ordinance shall take effect on or after the first day of 
      March next.  Feby. 9th 1838.

      On Motion. 
                  Resolved that the Mayor be and he is hereby authorized to call 
      a meeting of the Council at any time he may think it expedient, by 
      requesting the Clerk to notify each member of the time, and place, of 
      meeting.

      On Motion.  Resolved the salary of the City Clerk 
      should be four hundred dollars, for the present year—That the City 
      Surveyor shall be paid for services under the City—the amount to be fixed 
      to charge, and receive, from individuals, two dollars for each and every 
      lot, by him surveyed and staked off.

      quorum the council adjourned to Monday March 8th.

      City Council March 23rd 1838 
                  The Council met in pursuance of notice—given by the Clerk at 
      the request of the Mayor. 
                  Present the whole Board. 
                  Resolved by the Mayor and Council &c.  That officers elected 
      by the Council on the 7th & 9th of February last be and they are here by 
      reelected.  And that the Clerk notify all officers who are required to 
      give Bond, that they must comply with the conditions their appointments, 
      on or before the 15th April next.

                  On Motion; Resolved; That the committee appointed to 
      superintend the building of a Guard House, be and they and they are hereby 
      requested to consult and unite with the Judges of the Inferior Court of 
      Glynn County, in the erection of a Jail for the City and county. 
                  On Motion; Resolved; That the Mayor and Council will hereafter 
      meet on the first Monday in every month, at 3 o.c. P.M.

                  Special Meeting called by the Mayor.  Present the Mayor,

                  On Motion; Resolved; That the Jail for the City and County, 
      shall be erected on Hillsborough Square, and that the building Committee 
      shall select the part of said square, on which said Jail shall be erected. 
                  The Bond of Thomas P. Moody Povst.[?] was accepted. 
                  On Motion; Resolved; that the Clerk have ten quires[?] Blank 
      Tax Bills printed for the use of the City.

      At the same Meeting April 30th 1838 
                  Ordinance 
                  Be it ordained by the Mayor and Council of the City of 
      Brunswick; and it is hereby ordained by the authority of the same.  That a 
      pole Tax of one dollar shall be assessed and levied upon all white male 
      inhabitants over twenty one, and under sixty years of age, who were 
      residing in this City on the first day of April last.  And that the City 
      Collector be and he is hereby authorized and required to collect the same.

                  The Clerk having read the minutes of the last meeting; a 
      communication was received from J.S. Locke Esqr., resigning the 
      office of street commissioner, which was read and accepted and ordered to 
      be filed. 
                  On Motion.  A.L. King Esq. unanimously elected street 
      commissioner; to fill the vacancy occasioned by the resignation of J.L. 
      Locke. 
                  On Motion; Resolved; by the Mayor and Council of the City of 
      Brunswick That the street commissioner be and he is hereby requested to 
      have Bay Street opened forthwith and the necessary briges [sic] built. 
                  And that he have G Street opened between A & B Sts. 
      Immediately. 
      An Ordinance to name the Squares in the addition. 
                  Be it ordained by the Mayor and Council of the City of 
      Brunswick and it is hereby ordained by the authority of the same.  That 
      the Square between G and H Streets be and the same is hereby named 
      “Magnolia Square”—that the Square between L and M Street be and the same 
      is hereby named “Orange Square” and that the Square between L[?] and R 
      Streets be and the same is hereby named “Palmetto Square”.  The said 
      squares all being between B and D Streets.

                  Special Meeting Called by the Mayor.

                  A.H. Meriam Vandue Master; offered as his Security 
      Jos. Bancroft and J.L. Locke, who are approved of and accepted 
      by Council. 
                  The following Ordinance in relation to the issue of Change 
      Bills or Small Notes was then passed. 
                  Be it Ordained by the Mayor and Council of the City of 
      Brunswick, and it is hereby ordained by the authority of the same.  That 
      the Mayor of said City be, and he is hereby, authorized and required to 
      issue any amount of Change Bills, or small notes, not exceeding five 
      thousand dollars.  No one of said notes to be over one dollar, nor less 
      than twelve and a half cents—Said notes to be issued in the name of the 
      “Mayor and Council of the City of Brunswick,” payable on demand and signed 
      by the Mayor. 
                  Sec. 2nd.  And be it further ordained by the authority 
      aforesaid:  The faith, and all the property of the City, is hereby 
      pledged, for the redemption of said notes.

      City Council June 14th 1838 
                 Special meeting called by the Mayor. 
                  Present, the Mayor, H.A. Breed, James Moore, Jno. Franklin,

                  On Motion; Resolved; by the Mayor, and Council, of the City of 
      Brunswick, that six hundred dollars be and the same is hereby appropriated 
      to purchase a fire engine and five hundred feet of hose, for the use of 
      the City, and that H.A. Breed Esq. be, and he is hereby authorized, 
      to purchase the same at the North, to be paid for, our of the City funds, 
      by an order drawn on the City Treasurer.

                  On Motion;  Mr. Joseph Bancroft

                  The following Ordinance to vacate part of Z[?] Street was

      Brunswick, and it is hereby ordained by the authority of the same, That Z 
      Street between J and K Streets be, and the same is, hereby vacated and 
      abolished and ordered to be closed, for the benefit of the Lot-holders on 
      said Z Street, and the title to the land of said Z Street is hereby 
      vested, in the Said Lot holders.

                  H.A. Breed Esq. having retired. 
                  On Motion; Resolved; by the Mayor and Council of the City of 
      Brunswick;  That the following expression of their sentiments in relation 
      to H.A. Breed Esq. a member of the Board, be entered among the 
      proceedings of this meeting and a Copy thereof signed by the Mayor in the 
      name of the Council and attested by the Clerk be transmitted to him. 
      To H.A. Breed Esq. 
                  Dear Sir—We cannot permit you to leave us, although we hope 
      your absence will be but brief, without expressing to you our thanks for 
      you services as a member of this Board, and for the improvements you have 
      made in, and the benefits you have conferred upon this place.  It afford 
      us pleasure to say, that in our opinion, no individual residing among us 
      has done so much, to promote the interests and improve the appearance of 
      our City as yourself. 
                  You have our most cordial wishes for your posterity and we are 
      fully of the opinion that your untiring industry, strict economy and 
      perseverance in your business will be crowned with success.

      City Council Monday July 2nd 1838 
      Regular Meeting 
                  Present, the Mayor, Jas. Moore, John 
      Franklin, Jr., U. Dart and Chls. Davis. 
                  The Clerk read a communication for Wm. M. Miller 
      requesting the appointment of Notary Public for the City of Brunswick and 
      Motion; he was duly elected to that office and the Clerk requested to 
      notify him of his appointment. 
                  On Motion; Resolved; that John Franklin, Jr., P. McGuire, 
      John R. Hazzard and George Harrington shall receive their 
      licenses the present year for ten dollars each they having already paid 
      the sum of five dollars to the County. 
                  The following ordinances were passed and ordered to be 
      published. 
                  An Ordinance to prevent vice and immorality on the Sabbath.  
      Be it ordained by the Mayor and Council of the City of Brunswick, and it 
      is hereby ordained by the authority of the same, That, from and after the 
      passing of this Ordinance, each and every person who shall do or perform 
      any labor, business, or work on the Lord’s day commonly called Sunday, 
      (works of necessity or charity excepted) shall for every such offence be 
      subject to pay a fine not less than three nor more than ten dollars. 
                  Sec. 2.  And be it further ordained by the authority 
      aforesaid, That each and every person who shall aid, assist promote or 
      abet any horse racing, boat racing, hunting, fishing, bowling, billiard 
      playing, or other public game or sport of any kind in this City on Sunday 
      shall for every such offense be subject to pay a fine of not less than 
      five nor more than one hundred dollars;

      and each and every person who shall hereafter be 
      guilty of, or commit any riotous or disorderly act in this City on Sunday, 
      shall be subject to pay the penalty aforesaid. 
                  Sec. 3.  And be it further ordained by the authority 
      aforesaid, That each and every person who opens or causes or permits to be 
      opened, his, her or their store, grog shop, or barroom (unless such 
      barroom be attached to a licensed tavern or eating house) on Sunday, or 
      keeps or permits the same to be kept open on that day, for the purpose of 
      selling liquor or merchandize, shall for every such offense be subject to 
      pay a fine of not less than five nor more than fifty dollars, and each and 
      every tavern keeper, hotel keeper, or public house keeper who suffers or 
      permits disorderly conduct in his or her house on Sunday shall be subject 
      to pay the penalty last aforesaid. 
                  Sec. 4.  And be it further ordained by the authority 
      aforesaid, That one half of all the fines collected under the provisions 
      of this Ordinance shall go and be paid to the informer, and the other half 
      shall be paid into the City Treasury for the benefit of the City.  And it 
      is hereby declared to be the duty of the City Sheriff, Constable and other 
      officers of said city; to enforce the provisions of this Ordinance.

                  An Ordinance To Prescribe the mode of 
      Enforcing the City Laws. 
                  Sec. 1.  Be it ordained by the Mayor and Council of the City 
      of Brunswick and it is hereby ordained by the authority of the same, That 
      it shall be and it is hereby declared to be the duty of each and every 
      member of the City Council of said city, to arrest, or order and direct 
      the Sheriff or some Constable of said City to arrest, each and every 
      person who in his presence or to his knowledge violates or has violated

      any ordinance of said city, and the offender so 
      arrested shall be brought forthwith before the Mayor or some member of 
      Council other than the one making or causing the arrest, when a trial 
      shall immediately be had; unless the defendant requests a postponement of 
      the same in which case a reasonable time shall be allowed him to prepare 
      for his trial, on his entering into bond with good security to the said 
      Mayor and Council, for his appearance at the time required, and in case of 
      his not appearing the sureties shall be answerable, &c. 
                  Sec. 2.  And be it further ordained by the authority 
      aforesaid, That it shall be the duty of the Mayor and each member of the 
      City Council on complaint being made under oath or affirmation, that any 
      ordinance of said city has been or is then being violated, setting forth 
      the particulars, so far as known; of such violation, to issue a summons or 
      warrant to cause the offender to appear or be brought before him at a 
      certain time and place, or forthwith as he may think proper to answer the 
      charge of the complaint, when a trial shall immediately be had, unless the 
      said defendant requests a continuance which may be granted in the mode 
      prescribed in the first section hereof.  And in all cases in which the 
      amount of the fine or penalty is not absolutely fixed by the ordinance 
      imposing the same, the amount of it shall be determined by the Mayor or 
      member of Council before whom the offender is tried. 
                  Sec. 3.  And be it further ordained by the authority 
      aforesaid, That the law of evidence as in force in this State, shall be 
      adopted in all trials before the Mayor or any member of Council. 
                  Sec. 4.  And be it further ordained by the authority 
      aforesaid, That is any defendant shall be dissatisfied with the decision 
      of the Mayor, or member of

      Council, before whom he was tried, he may, before he 
      leaves the office where his trial took place, demand and appeal to the 
      Mayor and Council, which shall be granted on his giving security as 
      directed in the first section of this ordinance.  And all appeals so taken 
      shall be tried, if possible, at the first meeting of the Mayor and Council 
      thereafter.  And in case the defendant should be convicted, the Mayor 
      shall immediately proceed to carry into effect the decision of the 
      Council. 
                  Sec. 5.  And be it further ordained by the authority 
      aforesaid, That every person brought before the Mayor or any member of 
      Council charged with having committed an offence, shall have a fair and 
      impartial trial.  And the said Mayor or member of Council shall, on 
      request, issue a subpoena for defendant’s witnesses, and also for 
      witnesses on the part of the prosecution, if necessary.  And in all cases 
      of conviction or default before the Mayor or any member of Council, unless 
      the fine or fines and costs be forthwith paid, the Mayor or such member of 
      Council shall immediately (except in cases of appeal) issue a warrant of 
      distress against the goods and chattels, lands and tenements of the 
      defendant for the amount of the fine or fines and costs, which he has been 
      adjudged to pay; and the sheriff or Constable to whom any such warrant may 
      be directed, shall first take in execution sufficient of the defendant’s 
      goods and chattels to satisfy the same, if to be found; if not, then the 
      lands and tenements of said defendant shall be levied upon, and such an 
      amount sold as will satisfy said execution.  All sales of real property by 
      virtue of this ordinance shall be advertised and held in such manner as 
      Sheriff’s sales of real estate are directed to be advertised and held in 
      this State.  And all sales of personal property by virtue hereof, shall be 
      held at the most convenient place for

      holding the same, and notice thereof containing a 
      description of the property to be sold, shall be published three times in 
      some newspaper printed in said city, giving at least twenty days notice of 
      the time and place of sale.  And if the property offered for sale shall 
      sell for more than enough to satisfy the execution or executions against 
      the defendant, such overplus shall be returned to said defendant. 
                  Sec. 6.  And be it further ordained by the authority 
      aforesaid, That in case sufficient personal or real estate can not be 
      found to satisfy such executions as may be issued by virtue of this 
      ordinance, then and in every such case the Mayor or member of Council who 
      issued the warrant of distress shall issue a capias ad satisfaciendum for 
      the capture and detention of the defendant the number of days therein 
      specified, not to exceed the number of dollars said defendant has been 
      fined. 
                  Sec. 7.  And be it further ordained by the authority 
      aforesaid, That all writs, summonses, warrants, subpoenas and other 
      processes issued by the Mayor or nay member of Council, shall, issue in 
      the name of “The Mayor and Council of the City of Brunswick,” and shall be 
      signed by the Mayor or some member of Council and directed to the sheriff 
      or some constable of said city, whose duty it shall be to execute the 
      same.  And the fees of the sheriff and constable of said City shall be the 
      same as the fees allowed to the sheriff and constables of the County of 
      Glynn.  And the fees for issuing the processes, hearing the trial, &c., 
      shall be the same that Justices of the Peace receive for like services.

                  To prevent Nuisances, &c. &c. 
                  Be it ordained by the Mayor and Council of the City of 
      Brunswick, and it is hereby ordained by the authority of the same.  That 
      from and after the passing of this Ordinance, any person or persons, 
      within the limits of this City, who shall permit or suffer the carcass of 
      any animal that was owned by, or in the possession or keeping of him, her 
      or them previous to its death, to remain above, upon, or so near the 
      surface of the ground as to cause any disagreeable smell, shall be subject 
      to a fine not of less than five dollars, nor more than twenty dollars. 
                  Sec. 2.  And be it further ordained by the authority 
      aforesaid, That any person or persons who shall hereafter place, put, or 
      throw, or cause, or direct to be placed, put, or thrown, any carrion, 
      offal, nauseous or offensive matter or thing, into or upon any public 
      square, street, drain, or other place, or into or upon the property of any 
      person or persons, shall be subject to a fine of not less than five nor 
      more than twenty dollars.  And any person who shall hereafter permit or 
      suffer any carrion, offal, or other nauseous or offensive matter or thing, 
      to be, or remain upon or within the premises, lot, or piece of ground, 
      owned or occupied by or in the possession of him, her, or them shall be 
      subject to the penalty aforesaid. 
                  Sec. 3.  And be it further ordained by the authority 
      aforesaid, That any person or persons who shall kill, or cause to be 
      killed, any animal or animals, in this City, and permit and suffer the 
      same, or any part thereof, to remain above, upon, or so near the surface 
      of the ground, as to produce or cause any disagreeable or offensive smell, 
      shall be subject to a fine not less than five nor more than twenty 
      dollars. 
                  Sec. 4.  And be it further ordained by the

      authority aforesaid, That any person or persons who 
      shall put, place, or throw, or shall cause or procure to be put, placed, 
      or thrown, any dirt, mud, logs, sticks, brush, or other matter, into any 
      ditch, drain, or sewer, in this city, shall, for every such offence, pay a 
      fine not less than five nor more than fifty dollars, together with the 
      expences [sic] of removing the same. 
                  Sec. 5.  And be it further ordained by the authority 
      aforesaid, That it shall be the duty of the Sheriff and all the Constables 
      and other officers of this City to carry the provisions of this ordinance

      Secretary of the Treasury of the U.S. 
                  Whereas an appropriation has been made by 
      Congress for placing Buoys on the Brunswick Bar, and whereas the rapid 
      increase of the city of Brunswick, has rendered it a place of much 
      importance to the commerce of the Country—Therefore, Resolved, by the 
      Mayor and Council of the City of Brunswick That the Hon. Levi Woodbury, 
      Secretary of the Treasury of the U. States, be and he is hereby most 
      respectfully requested to have Buoys placed on the Brunswick Bar, and 
      along the channel in such places as may be necessary. 
                  And be it further Resolved, That tin the opinion of the said 
      Mayor & Council, Captain Wm. A. Howard, of the U.S. Revine[?] 
      Cutter Madison, is a gentleman well qualified to place said Buoys; he 
      having recently visited this place and become acquainted with the Bar. 
                  The Mayor & Council also beg leave to state that the Light 
      House on St. Simons Island

      and that the lamps therein are entirely too small for a Light House on the

      City of Brunswick, shall be subject to pay a fine of not less than five 
      nor more than fifty dollars, for each offence; one half to go & be paid to 
      the informer, & the other half to the City Treasurer, for the benefit of 
      the City.  And no License granted by the said Mayor & Council, shall be 
      transferred or assigned.

      has in possession, or keeps any Billiard Table or Bowling Alley, and 
      allows or permits the same to be used, or played upon, on Sunday, within 
      said City, shall be subject to pay a fine of not less than twenty, nor 
      more than one hundred dollars; and the owner or owners, keeper or keepers 
      of every Billiard Table or Bowling Alley, which shall or may be hereafter 
      played upon, or used on Sunday, within said City, shall each be subject to 
      pay the penalty aforesaid: one half of said fine to go & be paid to the 
      informer, the other half to the City Treasurer for the benefit of the 
      City.

      borrow money, &c.” as requires the notes to be signed by the City 
      Treasurer and prescribed the form of the notes, wherein the Treasurer of 
      the City of Brunswick is authorized and required to give said notes, shall 
      be, and the same is hereby repealed. 
                  Sec. 2.  And be it further ordained by the authority 
      aforesaid, That the note given by the said Mayor to Col. Henry Dubignon 
      for five hundred dollars, in the name of the Mayor and Council of the City 
      of Brunswick, dated July 18, 1838, be and the same is hereby declared to 
      be valid, legal and binding upon the said Mayor and Council, according to 
      the promise expressed in said not; the money for which said note was given 
      being for the use of said City.  And all notes hereafter given for money

      James Moore to keep a public house and retail spirituous liquors of 
      any quantity. 
                  Rice, Parker & Co. were authorized to sell liquor by 
      the quart or larger measure. 
                  J.W. Pettigrew was licensed to keep a public house and 
      sell liquors in any quantity. 
                  Dart, Barrett & Co. were licensed to sell liquors by 
      the quart or larger measure. 
                  On Motion, the following Resolutions were unanimously adopted: 
                  Whereas Tho. Butler King, Esq. in the year 1836, laid 
      his headright upon, and had surveyed, certain vacant lands commonly called 
      Commons land, adjoining the old town of Brunswick, which were granted to 
      him under the laws regulation headrights; and the fact having been 
      satisfactorily ascertained by the Mayor and Council that this land did not 
      & never did belong to the town or city of Brunswick, but that it was 
      vacant and subject to be run under the law regulating headrights.  And 
      Mr. King, notwithstanding he had in the opinion of our legal advisers, 
      a perfect right to retain this

      land and use it for his own benefit, has most 
      generously given it to the Brunswick and Florida Rail Road Company to aid 
      them in constructing one of the most magnificent works in the country.  
      Therefore 
                  Resolved, By the Mayor and Council of the City of Brunswick, 
      and it is hereby resolved by the authority of the same, That in 
      consequence of having been informed on good authority, that certain 
      Trustees of the Glynn County Academy are about to draw up a petition, 
      praying the Legislature to cause scifacias[?] to issue or some other 
      proceedings to be instituted against Thomas Butler King, Esq. to 
      set aside or annul his grant for the aforesaid land, that the Mayor and 
      Council of the City of Brunswick hereby disclaim any right or title to 
      said land.  And the said Mayor and Council most respectfully request the 
      Hon. The Senate and House of Representatives of the State of Georgia, in 
      General Assembly met, not to interfere in any way with the grant to 
      Thomas Butler King, Esq. for the aforesaid land, commonly called 
      Commons land. 
                  And be it further Resolved by the authority aforesaid, That 
      the Mayor and Council, and in their opinion all the citizens of Brunswick, 
      are perfectly satisfied with and give them full sanction to, the 
      proceedings of Thomas Butler King Esq. in laying his headrights on 
      the aforesaid vacant land commonly called Commons, & in obtaining a grant 
      for the same.  And the Mayor and Council hereby tender their thanks to 
      Mr. King for his unremitted [sic] exertions in form of our young and

      not less than thirty nor more than one hundred dollars for each and every 
      offence; one half of said fine to go to the informer and the other half to 
      be paid into the City Treasury for the benefit of the city. 
                  And be it further ordained by the authority aforesaid, That 
      the City Clerk be and he is hereby authorized to grant licenses to persons 
      wishing to sell goods, wares or merchandize, on board any vessel or boat, 
      or at or upon the wharves or landings in this city; and that for each of 
      said licenses said Clerk shall ask and receive the sum of thirty dollars,

                  Moses W. Wilson was elected Lumber Measurer 
                  E.C.P. Dart was elected City Treasurer & Collector 
                  Benj. Talbot was elected City Constable 
                  Robert Walsh and Geo. Harrington were appointed 
      Auctioneers and are required to give the necessary bonds before entering 
      upon the duties of their appointment. 
                  On motion of Alderman Dart, Charles Davis was 
      appointed to take a census of all able persons residing in this city in 
      the month of March, liable to pay a poll tax. 
                  The Mayor and Aldermen Dart and Moore were 
      appointed a Committee to value all the property real & personal in the 
      City, & report to the City Council. 
                  On motion of Alderman Moore, the Mayor was authorized 
      to pay one dollar each to nineteen men who were employed to watch the city 
      on the night of the 3d. inst. 
                  On motion of Alderman Ballard, the poll tax paid by 
      Wm. Manley[?] the past year be refunded. 
                  On motion of Alderman Dart, the Mayor was appointed a 
      committee to hire two men to watch the city at a sum not exceeding fifteen 
      dollars each, per month, for one month.

                  On motion ordered, that a poll tax of one dollar be assessed 
      on all male person over the age of twenty-one, residing in the city of 
      Brunswick on the first of March last past. 
                  On motion of Alderman Franklin, Resolved that the city 
      pay twenty dollars per month to the two Watchmen employed to watch the 
      city for the past month & that the watch be discontinued. 
                  The following Ordinance in relation to the opening of F & King 
      Street was passed:  Be it ordained by the Mayor & Council of the City of 
      Brunswick & it is hereby ordained by the authority of the same, That F 
      Street running between the old town and the addition thereto, be & the 
      same is hereby extended along the Eastern Boundary and one hundred feet 
      beyond the North Eastern corner of said old town, forty five feet in 
      width. 
                  And be it further ordained by the authority aforesaid, That a 
      street one hundred feet wide shall be laid out & opened from the North 
      East end of F Street along the Eastern Boundary or line of said Old town 
      running the whole length of said old town to the South Eastern corner 
      thereof.  And the Mayor is hereby directed to cause said street to be

      property in the city of Brunswick, according to the valuation of the

      used in the Bank in this city & that it be taxed accordingly.

                  Met agreeable to adjournment.  Present

                  The following Resolution was passed:  Resolved by the Mayor & 
      Council of the City of Brunswick & it is hereby Resolved by the authority 
      of the same, That the improvements which the Mayor has had made in the 
      streets & ditches are hereby sanctioned and approved, & that he is hereby 
      appointed Street Commissioner from & after the 24th day of June last.  And 
      he is hereby requested to proceed in having the ditches cleared and the 
      streets improved.  (The above Resolution was offered by the Mayor.) 
                  The following Ordinance was passed & ordered to be published 
      in the Brunswick Advocate: 
                  Be it ordained by the Mayor & Council of the City of Brunswick 
      & it is hereby ordained by the Authority of the same, That any person or 
      persons who shall hereafter destroy, cut, deface or injure, any tree or 
      sapling preserved, set out or growing in any street or public square in 
      this city, shall be subject to a fine of not less than five nor more than 
      fifty dollars for each offence. 
                  Resolved, That the offer of J. Franklin to build a City 
      Hog Pen for the sum of five dollars be accepted, & he is hereby requested 
      to attend to the same immediately. 
                  The following was offered by the Mayor & passed:

      Committee to consult & act with the Justices of the Inferior Court of 
      Glynn Co. in building a Jail for the city & county, & that one half of the

                  Resolved, That the Trustees of Glynn Co. Academy, be & they 
      are hereby authorized to erect an Academy on any Public Square they may 
      think proper in this city. 
                  The following proceedings took place in relation to the 
      appointment in April last of a pilot:  Whereas the appointment of a pilot 
      during the Summer with a Salary is thought by the Council to be 
      inexpedient in consequence of there not being sufficient business to 
      warrant the same; & whereas no pilot has yet received a License from said 
      Council it is 
                  Resolved by the Mayor & Council aforesaid, that the Resolution 
      in relation to the appointment of J.A.D. Lawrence as pilot for the 
      Bar & Harbor of Brunswick, passed December 11th 1838, be & the same is 
      hereby repealed & annulled. 
                  Resolved, That the Council hereafter meet on the first Monday 
      in each month at 4 o’clock in the afternoon.

                  The Clerk of the City Council being absent, on motion, 
      James Moore was appointed Clerk pro tem. 
                  The following ordinance was passed: 
                  Resolved by the Mayor & Council of the City of Brunswick & it 
      is hereby resolved by the authority of the same, That a Hospital be 
      immediately prepared for indigent sick persons in this city; and that 
      Maj. U. Dart, James Moore & Geo. Harrington be a 
      Committee to prepare & furnish said building and to admit into the same 
      such persons as may in their opinion be in need of medical attendance & 
      public charity. 
                  And be it further Resolved, That said Committee be & they are 
      hereby authorized to furnish the necessary food, medicine, medical 
      attendance & nurses & the same to be paid out of the City funds. 
                  And be it further Resolved, That each and every person nursed 
      & taken care of in said Hospital, shall if able, pay four dollars per 
      week; and for any time less than one week such person shall pay one dollar 
      per day, & all physicians bills for medicine & attendance. 
                  And be it further Resolved, That the Mayor or any member of 
      Council shall have the power to admit into said Hospital such persons as 
      he may think proper.

      hereby appropriated for a city Burial Ground for the citizens; & the four 
      acre Lot be appropriated for a Public Burial Ground or Pottersfield.

      additional expense the printing of the City Ordinances may be to the 
      present time. 
                  The following Resolution was likewise adopted:  Resolved, That 
      an equal proportion of the amount paid by the Lot holders over & above the 
      expenses of advertising lots for sale for taxes 3 1/2 months, be refunded 
      to paid lot holders as soon as that proportion can be ascertained—provided 
      the same be called for within six months from that time; & that the Mayor 
      be authorized to draw on the Treasurer for the same; and that Alderman

      the same shall be wanted for public use; at which time he is to deliver 
      the possession thereof on receiving three months notice from the Mayor & 
      Council to that effect. 
                  On motion of the Mayor Messr. Joseph Bancroft & 
      Theodore Dart were appointed a committee to examine the accounts of

      meeting of Council the subject to enquire about hiring $2000 for city use, 
      had leave to defer their report until the next meeting of Council. 
                  The Council then proceeded to the choice of officers for the 
      coming year.  Chas. Davis was elected City Clerk.  E.C.P. Dart 
      Treasurer & Collector.  Moses W. Wilson Surveyor of Lumber with 
      authority to appoint Deputies.  Thos. H. Wood, Wood Measurer.  
      James Moore, City Surveyor.  James Moore Vendue Master.  Dr. 
      Wm. P. Wilson, Health Officer.  Benj. Wilson City Sheriff.  
      Horace B. Harris, City Constable.  George Stockwell Harbor

                  On motion of the Mayor pro tem, Resolved, That the committee 
      on Streets be requested to put up in several public places in the city 
      advertisements for proposals to open Mansfield Street from Bay Street to

                  Mr. George Stockwell was elected Captain of the city 
      patrol. 
                  On motion of Ald. Moore, Resolved, That a poll tax of 
      one dollar be assessed on all male persons of the age of 21 & upwards 
      residing in the city, on the first of March; & that the Treasurer & 
      Collector be requested to take a census of all such persons; for which 
      services he shall be paid the sum of $5.00.

                  Special meeting.  Present the Mayor, & 
      Ald. Bancroft, Stockwell, Scranton, Dart & Moore. 
                  The Mayor resigned his appointment of Street Commissioner 
      Assessor, & Ald. Moore was appointed in his stead.| 
                  The following Resolution was offered by the Mayor, adopted & 
      referred to the Committee on Finance:  Resolved, That the Bank of 
      Brunswick be called upon to return all the due bills issued by the Mayor & 
      Council of said city of 1838; for which they have signed a receipt, or in 
      lieu thereof to place the amount of said due bills to the credit of the 
      city, with power to draw for the same. 
                  Resolved, That Mr. Andrew L. King the late Mayor of 
      this city, be called upon to furnish a statement of all bills issued

      by him in pursuance of a Resolution passed by the 
      Council of the City of Brunswick, dated June 1st, 1838. 
                  The Committee on Streets report that they have received 
      proposals from five individuals offering for the opening of Mansfield 
      Street & find that James Moore and B. Duffy are the lowest 
      bidders, both offering to do the same for $300.  They submit to Council 
      that one or the other be accepted & beg leave to refer it to the Council 
      which of the two proposals shall be taken.  On this subject the following 
      Resolution was adopted.  Resolved, That the lowest bidder of the two 
      parties whose offers are the same, shall be entitled to the contract. 
                  The following was offered by Ald. Dart & adopted:  
      Resolved, That the Committee on Health be instructed to take the subject 
      matter contained in a letter of the Hon. Thos. Butler King, dated 
      5th inst. relative to the health of this city into consideration; & that 
      they be requested to report their proceedings to the next Council. 
                  Te petition of James Wilson & Peter H. Rowe to 
      be appointed pilots for the Bar & Harbor of Brunswick was granted under 
      the specifications of the act relating thereto. 
                  The application of James Moore for License to retail 
      spirituous liquors was granted. 
                  The Council then adj. to Saturday, 21st inst. at 4 o’clock

      City Council 
      Saturday March 21st, 1840 
                  Council met according to adjournment.  
      Present the Mayor & Ald. Dart, Bancroft, Stockwell, Moore & 
      Scranton. 
                  The following in relation to change bills was passed & ordered 
      to be published in the Brunswick Advocate.  All persons holding change 
      bills of the city of Brunswick signed by A.L. King Esq. Mayor, are 
      hereby requested to present them for payment to I.C. Plant, cashier 
      of the Bank of Brunswick, where funds have been lodged by the Council for 
      their redemption. 
                  In pursuance of a Resolution adopted by the Council at the 
      last meeting, in reference to a communication from the Hon. Thomas 
      Butler King, the Committee on Health beg to report that they have 
      obtained several certificates relative to the salubrity of thee city, 
      which are hereby presented. 
                  On the above subject the following resolution was adopted:  
      Resolved, That the report of the Committee on Health be accepted & the 
      same together with accompanying documents be forwarded forthwith to the 
      Hon. Thos. B. King, M.C. & the said Mayor & Council hereby certify 
      that the persons from when certificates have been procured are personally 
      well known to them; & that they are person of good character & 
      respectability & that full credit ought to be given to said certificates.

      further resolved that the foregoing be signed by the 
      Mayor & Council & countersigned by the Clerk & affix the City seal 
      thereto. 
                  The following Resolution offered by Ald. Moore was 
      adopted.  Resolved, That before any retail license shall be granted in 
      this city, the applicants shall give a Bond & at least one good security 
      to the City Clerk in the sum of five hundred dollars for keeping an 
      orderly house & be of good behavior directing[?] the continuance of said 
      license.  Said bonds to be made payable to the Mayor & Council & their 
      processors in office. 
                  Wm. H. Hazzard, Barney Duffy & A.O. Segue were 
      authorized to be licensed to retail spirituous liquors. 
                  The following Resolution was adopted, Resolved, That the City 
      Clerk be authorized to compile & print in pamphlet form to the number of 
      100 copies, the City Charter & all amendments, together with the several 
      ordinances of Mayor & Council now in force; & that the sum of $50 be 
      appointed for publishing the same. 
                  On motion of Ald. Bancroft, Resolved, That the Report 
      of the Assessors be accepted & that the tax on Real Estate be assessed at 
      3/16 of one per cent; & that the tax on personal property be assessed at 
      one quarter per cent, except the capital stock of the Bank of Brunswick, 
      which shall be assessed at 1/8th per cent.

      Saturday April 18th 1840 
                  Special meeting.  Present, the Mayor & 
      Ald. Bancroft, Moore, Stockwell & Scranton. 
                  On motion of Ald. Bancroft, Resolved, That so much of 
      the resolution passed at the last meeting of Council as assessed at tax of 
      1/4 of one per cent on all personal property be so amended as to read 3/16 
      of 1 per cent; & that said 3/16 be only levied on personal property. 
                  On motion of Ald. Scranton, Resolved, That the Mayor & 
      Council of the City of Brunswick be authorized to issue change bills for 
      the benefit of said town not to exceed $2000 in amount, redeemable in one 
      year, & that said bills be of any denomination from 6 1/4 cts. to $1.00, 
      as may appear necessary. 
                  On motion of Ald. Bancroft, Resolved, That the 
      collector of Taxes be authorized to obtain[?] immediately for all Poll 
      taxes unpaid after this date. 
                  On motion of Ald. Moore, Resolved, That the Committee 
      on Finance call on the City Treasurer & request him to furnish a statement 
      of all the available funds now in the treasury at the next meeting of 
      Council on Thursday 23d inst. in order that it may be drawn for 
      immediately in payment of debts due by the city. 
                  On motion of Ald. Bancroft, Resolved, That the sum of 
      five dollars be paid to each of the Assessors of the last taxes for 
      services rendered.

                  On motion of Ald. Moore, Resolved, 
      That the resolution passed at this meeting authorizing the Mayor & Council 
      to issue change bills be amended so as to read payable on demand instead 
      of “redeemable in one year.” 
                  On motion of the Mayor, Resolved, That the following 
      proposition of Mr. James Moore in relation to issuing change bills 
      was accepted. 
                  “I propose to pay the city 8 per cent per annum for the use of 
      all the city change bills issued during one year & give a Bond for the 
      redemption of the same & keep a quarterly account of all bills issued; & 
      pay the interest on the amount put in circulation during each quarter at 
      the rate of 8 p ct. per annum; & I will give good & ample security to the 
      Mayor & Council in bonds of two thousand dollars for the redemption of any 
      & all bills issued as they may be presented with the understanding that no 
      more bills be issued than that amount, viz:  two thousand dollars.

      April 23d, 1840 
                  Met according to adjournment.  Present, 
      Ald. Bancroft, Wilson, Dart, Stockwell, Scranton & Moore. 
                  The Mayor not being present Ald. Bancroft was called to 
      the Chair.            
                  On motion of Ald. Scranton, Resolved, That the 
      Committee on Health be authorized to have surveyed & laid out in some 
      suitable place adjoining the city of Brunswick, six acres of ground for a 
      city Burying Ground; the same to be centrally located as possible; & that 
      said committee be further authorized to have erected around said ground a 
      suitable fence with gates. 
                  The committee on Finance in accordance with a resolution 
      requesting them to call on the City Treasurer in order to ascertain the 
      available funds belonging to the City beg leave to report that the City 
      Treasurer has a fund of about $537, that being the amount that was ordered 
      to be retained by his hands for the payment of overcharges in advertising 
      the lots during the past years. 
                  On motion of the Mayor pro tem, Resolved, That the Mayor be 
      requested to advertise for public sale, without any delay, the lands & 
      lots of all delinquent in taxes for the year 1838 & 1839. 
                  On motion of Ald. Dart, Resolved, That so much of the 
      proposition of Mr. Moore accepted at the last meeting of Council 
      authorizing him to issue the city change bills, be so amended as to 
      restrict the amount of bills to be issued to him to a sum not exceeding 
      one thousand dollars.

      Monday July 13, 1840 
                  Special meeting.  Present, the Mayor & 
      Aldermen Bancroft, Scranton, Moore & Stockwell. 
                  On motion of Ald. Moore, Resolved, That the River 
      Pilotage for the harbor of Brunswick be the same as that of that [sic] 
      Savannah. 
                  The Clerk of Council laid before the Board his resignation as 
      Clerk, which was accepted & the thanks of the Board tendered to him for 
      the satisfactory performance of his duties. 
                  On motion the Mayor, Resolved, That the Clerk be paid at the 
      rate of $200 per year for his services the past year. 
                  On motion of Ald. Moore, Resolved, That the Clerk pass 
      over to the Treasurer all Books, papers, &c. belonging to the City.  Adj. 
      to Thursday next 12 1/2 clock.
